On a recent visit to New York, Laila Mickelwait sat in the lobby of a hotel near LaGuardia Airport, sipping tea. She was raised in Riverside, California, where her mother, a former teacher, stayed home with Mickelwait and her two sisters.

On multiple occasions, he says, OnlyFans told him he over-moderated, particularly in relation to videos showing sex in public and to “third-party” content – material featuring people not registered with OnlyFans.

How the FBI tracks down child pornography predators

In March, 2020, members of the Canadian Parliament asked the government, in a letter to Prime Minister Justin Trudeau, to investigate MindGeek, and then launched a parliamentary investigation. But when she initiated a chat with a sales representative, posing as a prospective advertiser, the representative told her that TrafficJunky could still accept ad purchases using all major credit cards. The man who sent the text forwarded a nude photograph of her, the source of which she couldn’t figure out.

If that name sounds sinister, it’s because the dark web encourages activity that people would rather hide from view. It’s also dotted with sites that specialize in illicit pornography, including child pornography. It’s a part of the internet that you can’t find with traditional search engines such as Google. For decades, the Supreme Court has struggled to define just what material is so offensive as to be legally obscene, and to delineate limits on the government’s ability to regulate sexually explicit material.

Dark web child abuse: Hundreds arrested across 38 countries

Digital-fingerprinting software was being applied in all suspected cases of child-sexual-abuse and nonconsensual videos, which would prevent them from being re-uploaded in the future. The company also said that it had been developing software to identify and remove nonconsensual videos, which it planned to make available to other online platforms. A woman named Tina, a technology assistant and mother of three, told me that, in 2019, an abusive ex-boyfriend posted explicit videos of her on Pornhub without her permission. In addition to reporting the matter to the police, she said, she spent months filling out takedown requests on the site, explaining that the videos had been posted without her consent and contained her and her children’s real names and home address. The responses usually took several days, she said, and the company repeatedly asked her for proof of her claims. When the videos were removed, she said, they might reappear hours later, like a replicating virus, sometimes broken down into dozens of clips of a few seconds each.

The case involved New York’s child pornography law, which criminalized the production or sale of any visual depiction of children under 16 engaging in sexual acts, whether or not the depiction would be deemed obscene. The Court upheld the conviction of a man who sold two films of young boys masturbating to undercover agents. In this case, sexually explicit films were discovered in defendant Eli Stanley’s house by police, in the course of an unrelated investigation into his alleged bookmaking activities. He was convicted of “knowingly hav possession of … obscene matter,” in violation of Georgia’s obscenity law.

The Fight to Hold Pornhub Accountable

One expert in content moderation says the documents clearly show that OnlyFans has “some tolerance” for illegal material. “This suggests that they know the type of illegal content that their users are trying to upload enough to have templates for it,” says Dr Sarah Roberts, a co-director of the Center for Critical Internet Inquiry at UCLA in the US. If your reports list a credit card account under your name that you don’t remember opening, that might be a sign that thieves have used your personal information to sign up for a card in your name. Call that credit card provider and tell them that you never opened the account. If identity thieves have gained access to your credit card account, for instance, they can still use your card to make fraudulent purchases. The site, named Welcome to Video, was run from South Korea and had nearly eight terabytes of content involving child abuse – enough to store hundreds or even thousands of hours of video footage.

It provides templates for each successive warning – explaining why material has been removed, and that failure to comply with terms of service may result in the closure of the account. Internal documents, leaked to BBC News, reveal that OnlyFans allows moderators to give multiple warnings to accounts that post illegal content on its online platform before deciding to close them. Law enforcement agencies have arrested and charged 337 site users so far, across the U.S. and in the United Kingdom, South Korea, Germany, Saudi Arabia, the United Arab Emirates, the Czech Republic, Canada, Ireland, Spain, Brazil and Australia. “That’s more than 10,000 CD-ROMs full of imagery that’s no longer in the hands of child pornographers,” said Don Fort, chief of IRS Criminal Investigation. “These agents and prosecutors rescued some 23 children worldwide from abusive situations” in the U.S., Spain and the U.K., said Jessie Liu, the U.S. attorney for the District of Columbia. She described this type of crime as “one of the worst forms of evil imaginable.”
